I also voluntarily assume the risk of any loss, injury or damage to the person or property, which in any way arises from the participation in the activity described and provided by the commercial company.

In addition, EXPRESSLY WAIVER OF ANY CLAIM against MITO SPORT AND FITNESS LLC, its employed instructors, partners and / or directors arising from losses, injuries or damages, and I CANNOT DEMAND the company or its instructors and / or employees, partners or directors.

I further agree that all legal proceedings related to this Release and Disclaimer shall be processed under the laws and Courts of Miami, Florida.

AQUATIC PROGRAM POLICIES

1. INSTRUCTOR CONSIDERATIONS: I understand that, as justified and deemed appropriate by the course instructor; The student may be transferred to a class, removed from class as necessary due to the skills, preparation and behavior demonstrated. Refunds are not authorized. It is understood that the company cannot guarantee the same instructor, the same schedules to the student, and must be programmed according to the pre-established schedules. If the student cannot attend the scheduled class, they will lose the class, without being able to claim something from the instructors or the company. Once a class is scheduled, the student is obliged to attend and if he is unable to notify at least twenty-four (24) hours before the start of the class, by email, in case On the contrary, he will lose it and cannot claim compensation, nor can he request to reschedule classes for the lost lessons. The availability of the instructors who teach the classes are assigned by the schedule established by the company. The rotation of the same does not guarantee that the student has the class with the same instructor.

2. SUSPENSION OF CLASSES BY THE COMPANY: If the company MITO SPORT AND FITNESS LLC cancels a class due to the closure of the facilities caused by force majeure, weather, breakdowns and / or any other unforeseen emergency, classes will be rescheduled for another opportunity or The instructors will add additional time in any of the next classes to compensate for it, as long as classes are not previously scheduled at subsequent times. For example, if a class is canceled due to the weather, the company will reschedule the class or agree with the instructors to add an additional 15 minutes or 10 minutes in the following class meetings to cover missed class time. If we cannot give additional time before the session ends, it will be rescheduled. This notification may be made up to 1 minute before starting the activity.

3. JUSTIFICATIVE OF STUDENT ABSENCE: In the event that the student does not attend the scheduled class due to illness, they must bring a medical certificate, in this way the swimming class will be rescheduled.

4. TYPES OF CLASSES, DURATION AND RULES: We have three (3) types of swimming class: a) Private: These are classes taught to one (1) student; b) Semi-Private: These are classes taught to two (2) students; c) Group: These are classes taught to three (3) and four (4) students.

All classes will last thirty (30) minutes and are sold only and exclusively in packages of 8 lessons.

The swimming class package must be consumed within the next 30 business days following payment and according to the schedule established and selected by the student.

Group classes will be taught every day from Monday to Friday at the established times and semi-private and private, will be scheduled according to the availability of the system.

If you have selected a group class package and when entering the pool, only two (2) students or one (1) student are present, a Private class will be considered and therefore the class time will be reduced to twenty (20) minutes

Classes and schedules can not be guaranteed by the instructor or by any employee and the availability of the same at the time of making the entry through this system and may be modified without notice.

5. STUDENT BEHAVIOR: The student must have appropriate language and behavior during class hours, respecting the instructors and classmates. The child who does not comply with this rule will be withdrawn classes and will not be entitled to any claim.

6. METHOD FOR STARTING AND ENDING CLASSES: The student must be at the site indicated by the instructor ready to enter the pool with all its implements (bathing cap, hat and glasses). The instructors will strictly enforce the policy and students 3 years of age and under must wear a tight “swimsuit diaper” or tight plastic pants and a swimsuit on top, in addition to wearing a hat and glasses. The student must be ready with all their implements in the area destined to be picked up by the assigned instructor, obligation that must be mandatory to the representatives if the student is a minor, all this to start the class on time and stay with your child until the instructor picks them up. The student’s representative can pick you up from the instructor immediately at the end of the class. The student’s representative must remain on the premises while the minor student attends his swimming class. In order for the instructors to provide the most effective instruction, the student’s representative is asked to observe the classes from a safe distance. If the presence of the representative in the pool area creates a distraction for the student or the class, for the best interest of that class, the instructor and / or company management reserve the right to request that the representative move to another area designated by the instructors or employees of the company.

7. REFUND. A refund request must be made at least fourteen (14) days before the session. No refunds will be granted less than fourteen (14) days before the start of the session and / or once the session has begun.

8. ADDITIONAL INFORMATION ABOUT THE CLASSES. 9. COSTS AND PAYMENTS. The package of eight (8) Private classes will cost TWO HUNDRED FIFTY AND ONE DOLLARS WITH TWENTY CENTS ($ 251.20) in total.-

The package of eight (8) Semi-private classes will cost TWO HUNDRED TWENTY-TWO DOLLARS WITH TWENTY-FOUR CENTS ($ 222.24) in total.-

The package of eight (8) Group classes will cost ONE HUNDRED NINETY AND SEVEN DOLLARS WITH FIFTY-TWO CENTS ($ 197.52) in total.-

All packages must be paid in advance at the start of swimming lessons and must be confirmed by the administrative department.
